The Amsterdam Court of Appeal has issued an important ruling in favor of Schiphol's residents. The court ruled that the number of flights at the Dutch airport may be sharply reduced next year. Instead of 500,000 flights, only 460,000 flights will be allowed. Although most of the flight schedule for the coming winter has already been decided, flight restrictions are expected to be especially noticeable from the summer of2024.
Infrastructure MinisterHarbers had previously decided to reduce the number of flights as early as next year, but the airline industry went to court to challenge this decision. In April, the judge ruled that an extendedEuropean procedure should have been followed to limit the number of flights, halting the minister's plans.
This procedure, known as the "balanced approach," allows all interested parties to express their views. Although this procedure is already underway, it takes a long time. Ultimately, deregulation aims to reduce the number of flights per year to 440,000. However, to speed up the process, the government wanted to take a first step toward 460,000 flights, but this was reversed by the courts.
The court has now ruled that the "experimental scheme," based on which the minister wants to lower the flight ceiling, does not violatenational or European law. According to the court, European rules do not apply to the proposed measures. The experimental scheme is a temporary and short-term experiment that serves to prepare for possible future adjustments to the noise regulations in force, in which the government will follow the "balanced approach" procedure.
In other words, the temporary reduction of the flight ceiling is not considered an "operating restriction" as referred to in European legislation, and therefore a complicated and time-consuming procedure is not necessary.
